NGĀTI RANGITEAORERE NOMINATIONS FOR ELECTIONS TO THE NGĀTI RANGITEAORERE KOROMATUA COUNCIL

Nominations are now open for candidates for a position as a trustee on the Ngāti Rangiteaorere Koromatua Council.

A nomination must be in writing signed by not less than three (3) Adult Registered Members of Ngāti Rangiteaorere and endorsed with the consent of the nominee. Nomination forms are available on request from the Chief Returning Officer at the address below.

To be elected as a Trustee a nominee must, as at the closing date for nominations, be recorded in the Ngāti Rangiteaorere Register as an Adult Registered Member of Ngāti Rangiteaorere and must not:

• be bankrupt or have made any composition or arrangement with creditors;
• have been convicted of an indictable offence or any offence involving dishonesty (unless the nominee is an eligible individual for the purposes of the Criminal Records (Clean Slate) Act 2004); or
• be subject to a compulsory treatment order or to a care and protection order.

Any person who is a member of Ngāti Rangiteaorere, but who is not currently registered as a member, may apply to become registered.

All nominations for the position of trustee and/or applications for registration as a member of Ngāti Rangiteaorere must be received by the Chief Returning Officer at the address below no later than noon on Saturday 10 October 2015.

Ngāti Rangiteaorere and the Crown signed a deed of settlement on 14 June 2013.
Ngāti Rangiteaorere receives $750,000 financial redress and the return of culturally significant sites, which is in addition to a payment of $750,000 and the prior return of Te Ngae Mission Farm in 1993

The following is the text of an advertisement to be published in several newspapers:

Ngāti Rangiteaorere members will be asked to formally ratify (approve) the settlement offer made to Ngāti Rangiteaorere and the proposed Post Settlement Governance Entity (PSGE) by voting on whether or not to accept the DOS and PSGE. Two Ratification Information Hui will be held to provide information on the voting options:

The results of voting on resolutions 3 and 4 above will not have an effect on whether the DOS and PSGE are ratified.

You must be registered or make an application to register to receive a voting paper.

Registration forms will be available at these hui and online at: www.rangiteaorere.o.nz

Voting commences on 26 April 2013 and closes on 27 May 2013 at 12 noon.

"The Maori Appellate Court has issued its findings in respect of the Te Ngae Farm Trust. The issue was taken to court by trustees Tai Eru and Rangi Easthope and the NRCC supported this on behalf of Ngati Rangiteaorere. The Maori Land Court decision was appealed by Arama Pirika, Pirihira Fenwick and others. This is Maori Appellate court findings. It is a decisive win for Ngati Rangiteaorere iwi."

TE NGAE FARM TRUST DECISION

MARCH 2013

SETTLEMENT PROCESS GOING FORWARD

1. 1) The Ngāti Rangiteaorere Claims Committee (the entity mandated to negotiate the remaining historical claims of Ngāti Rangiteaorere) initialled a deed of settlement on 11 October 2012.
2. 2) The deed of settlement settles the Ngāti Rangiteaorere historical claims including the 1993 Ngāti Rangiteaorere partial settlement.
3. 3) In the 1993 settlement, Ngāti Rangiteaorere received Te Ngae Farm from the Anglican Church Mission Society and $750,000 from the Crown. Te Ngae farm lands are managed by Te Ngae Farm trustees.
4. 4) The redress included in the present deed of settlement includes the return of key sites to Ngāti Rangiteaorere including 700 acres in the Whakapoungakau ranges (upper reaches of the Okataina Scenic Reserve).
5. 5) The Ngāti Rangiteaorere Claims Committee believes that the best way for Ngāti Rangiteaorere to move forward is to combine all the assets from both settlements in to one governance entity.
6. 6) The Māori Land Court has considered the question as to who the beneficiaries are for the 1993 settlement. A majority of the Te Ngae Farm trustees (Pirihira Fenwick, Hiwinui Heke, Wharangi Cookson and Arama Pirika) have argued that the beneficiaries of Te Ngae Farm include Te Rorooterangi and Ngati Uenukukopako descendants. A minority of trustees argued only Ngati Rangiteaorere are beneficiaries. The Maori Land Court made a decision that the beneficiaries of the Te Ngae Farm are only Ngāti Rangiteaorere iwi. This decision has been appealed to the Maori Appellate Court by the majority of the trustees. A decision is pending.
7. 7) The Ngāti Rangiteaorere Claims Committee has therefore agreed with the Crown to spend the next month talking with the Te Ngae Farm and other Taonga trustees to consider the best governance entity to benefit Ngati Rangiteaorere.
8. 8) This is a significant matter for Ngāti Rangiteaorere to consider. The Te Ngae Farm Trust was established under the auspices of Te Ture Whenua Act nearly twenty years ago.
9. 9) This Full and Final Settlement must make sure that the right legal structure is in place for Ngati Rangiteaorere. The Iwi has been (5-6 years) debating a suitable Koromatua tribal structure to ensure that those who make decisions for Ngati Rangiteaorere’s future, truly has its’ interests at heart.
10. 10) The NRCC has presented an Iwi Development Plan to Ngati Rangiteaorere and have signed memorandums of understanding with the Rotorua District Council, Bay of Plenty Regional Council, Department of Conservation and Ministry of Agriculture and Fisheries.
11. 11) The Ngati Rangiteaorere Claims Committee remains committed to exerting its’ mana over its geothermal field in its’ rohe.
12. 12) The Ngati Rangiteaorere Claims Committee held 2 Information Hui on 10th March 2013 at Kia Maia Hall in Mangere, South Auckland and the 16th March 2013 at Waiohewa Marae, Te Ngae, Rotorua.
13. 13) These were to update Ngati Rangiteaorere on the settlement package and to hear a presentation from OTS appointed legal consultants, on the different PSGE structures and the PSGE structure proposed by the Ngati Rangiteaorere Claims Committee.
14. 14) NRCC is planning two Hui to be held in South Auckland (at Kia Maia Hall) and at Waiohewa Marae (Te Ngae, Rotorua) at dates to be announced.
15. 15) At that point we will provide information to all registered adult Ngāti Rangiteaorere members about the settlement package, the structure of the post settlement governance entity and the voting process that will allow the Ngāti Rangiteaorere members to vote on whether to:
    1. a) accept the settlement redress as set out in the initialled deed of settlement; and
    2. b) accept the post settlement governance entity (PSGE) that will receive and manage the settlement assets of Ngāti Rangiteaorere.
16. 16) A registration form is available from this website. Families are encouraged to actively seek enrolments from their own family members. Only those enrolled on the register will have the opportunity to vote. This is very important.
